Meeting location: Senior Center, 1555 Crystal Springs Road, San Bruno, CA.

City Council meetings are conducted in accordance with Roberts Rules of Order Newly Revised and City Council Rules of Procedure. You may address any agenda item by standing in front of the microphone until recognized by Council. All regular Council meetings are recorded and televised on CATV Channel 11 and replayed the following Thursday, at 2:00 pm. You may listen to recordings in the City Clerk's Office, purchase cassette and video copies, access our web site at www.sanbruno.ca.gov and San Bruno residents may check out video copies at the Library. In compliance with the Americans with Disabilities Act, individuals requiring reasonable accommodation for this meeting should notify us 48 hours prior to meeting.         Designation of September 20 – 26, 2009 as Fall Prevention Awareness Week in San Bruno.

4.   PRESENTATIONS:

      Present 30-Year Anniversary Service Award to Parks and Facilities Manager, Steve Freitas.

5.   REVIEW OF AGENDA:       

6.   APPROVAL OF MINUTES:  Regular Council Meeting of September 8, 2009.

7.   CONSENT CALENDAR: All items are considered routine or implement an earlier Council action and may be enacted by one motion; there will be no separate discussion unless requested by a Councilmember, citizen or staff.

a. Approve: Payroll of August 30, 2009.    

b. Approve: Accounts Payable of September 8, 2009.

c. Accept: Reconciliation of General Ledger to Bank Reports and the Investment Reports Dated August 31, 2009, as submitted by City Treasurer, John Marty.

9.   PUBLIC COMMENT ON ITEMS NOT ON AGENDA:

Individuals allowed three minutes, groups in attendance, five minutes.  If you are unable to remain at the meeting, ask the City Clerk to request that the Council consider your comments earlier.  It is the Council's policy to refer matters raised in this forum to staff for investigation and/or action where appropriate. The Brown Act prohibits the Council from discussing or acting upon any matter not agendized pursuant to State Law.

10.   CONDUCT OF BUSINESS:

a. Adopt Resolution Approving Proposed Tenant Improvement and Finishes Plans for Restaurant as Part of Development of ECR Commercial Project at the Crossing.

b. Adopt Resolution Accepting the San Bruno Bicycle and Pedestrian Study Report Funded by the Metropolitan Transportation Commission.

c. Adopt Resolution Authorizing City Manager to Approve Memorandum of Understanding (MOU) between the City and Law Enforcement Agencies in San Mateo and San Francisco Counties for Record Data Sharing within the West Bay Information Sharing System.

d. Adopt Resolution Authorizing City Manager to Execute Agreement with Cotton Shires & Associates for Geotechnical Construction Observation and Testing Services for the Rosewood/Madison Slope Stabilization Project in the Amount of $48,500.

e. Adopt Adopt Resolution Authorizing the City Manager to Execute Construction Contract with Con- Quest Contractors, Inc. for Belle Air Storm Drainage Improvements Project in the Amount of $76,700 and Approving Construction Budget in the Amount of $88,200 and Appropriate $85,000 from the Stormwater Enterprise Fund.

a.  Closed session to provide direction to legal counsel whether to initiate litigation. (Cal Gov't Code 54956.9(c).

b.  Closed session to confer with legal counsel regarding pending workers' compensation appeal. (Employee v. City of San Bruno and JT2 Integrated, Workers' Compensation Appeals Board, SFO 0500784) (Cal Gov't Code 54956.9(a).)
